These purchasing conditions are compiled in accordance with the provisions of the Electronic Commerce Act (Official Gazette No. 173/03, 67/08, 36/09, 130/11, 30/14, 32/19), Consumer Protection Act (Official Gazette No. 41/144, 110/15, 14/19 ) and the Mandatory Obligations Act (Official Gazette No. 35/05, 41/08, 125/11, 78/15 and 29/18), and constitute a prior notification within the meaning of the Consumer Protection Act (Official Gazette No. 41/14 , 110/15, 14/19).

All materials found on the website www.flyingcatgin.com are intellectual property of the Company and can be used only with its expressed permission as the copyright owner, trademark and / or design right holder.

Customer

A customer is any person who commits to legal transaction or acts on the market outside his trade, business, craft or professional activity and accepts the general terms of business of the Company (hereinafter: General Terms and Conditions).

 

Acceptance of the General Terms and Conditions is confirmed by the customer by ordering the product through the online store. Use of services and content on the www.flyingcatgin.com website is granted to adults only. The Company assumes no liability whatsoever for the breach of this stipulation. 

 

In accordance with applicable laws, it is prohibited to sell alcoholic beverages and other drinks containing alcohol to persons under the age of 18.

 

General provisions

These General Terms and Conditions are available to customers at all times and can be saved, reused, and reproduced. The General Terms and Conditions regulate the relationship between the customer as customer and the seller in relation to the terms and conditions of the ordering of products, the price of the products, the terms and conditions of payment, the liability for defects, the customer’s right to a written complaint, the right to terminate the contract, the terms of delivery of the product, as well as other data and other matters important for the conclusion of the contract via e-commerce. 

 

The General Terms and Conditions form an integral part of each purchase agreement concluded between the seller and the customer. Customers are required to provide accurate, valid and complete personal information when completing the registration form.

 

In accordance with its business policy, and without the need for prior notice, the seller is authorised to modify the content of the General Terms and Conditions and of other information related to this website. The amended Content of the General Terms and Conditions shall enter into force upon publication on this website.

 

Prices

The prices shown in the www.flyingcatgin.com store are retail, with VAT included, as well as a refundable fee of 0.50 HRK where applicable.

 

Payment options

Available payment options are the following:

 

• Wire transfer - has to be completed before shipping the order.

• Cash on Delivery - has to be completed upon delivery of the order.

 

Orders and Purchase Procedure

The purchase process commences with the action of ordering the product through the electronic order form. The purchase is undertaken by selecting the product in the desired quantity, after which the products are saved to the shopping cart. The shopping cart shows all selected products with their individual prices and the total price. The customer can change, delete, or increase the number of the selected products in the shopping cart.

 

After having selected the desired products and providing all the required information required for product sale and delivery, the customer can confirm the order by clicking the PLACE ORDER button.

 

Products are deemed to be ordered and the contract concluded once the customer has made the payment.

 

Some products may be unavailable or sold out. In such events, the customer will be notified by email. Upon receipt of such notice, the customer shall notify the seller by email whether the new delivery deadline is acceptable or if they wish to withdraw the purchase.

 

Product delivery

All products from our online store can be shipped only within the Republic of Croatia.

All prices listed on the website do not include shipping costs. The shipping cost is calculated separately, in relation to the total weight of the order and the shipping destination. 

The shipping cost is charged separately in the following ways, depending on the chosen payment option: 

 

• Wire transfer - the shipping cost is calculated by the Company once the customer confirms the order. The cost will be added to the total payment amount for the order, and included in the invoice. The order will be shipped once the customer has paid the entire amount (covering the order and the shipping cost).

• Cash on Delivery - the shipping cost is calculated by the delivery provider. It will be charged and invoiced separately by the deliverer.

 

Material defects / Goods damaged in transport

Our products are placed in protective packaging that ensures they cannot be damaged by common manipulation in transport.

 

The customer is obliged to inspect the received item for possible damages at the point of delivery. If there is any visible external damage, the customer is obliged to immediately notify the delivery service and refuse the delivery. In this case, the Company should be notified in order to arrange a new delivery or offer an alternative solution as soon as possible.

 

Unilateral termination of the contract

The customer may terminate the Contract within 14 (fourteen) days without giving any reasons. However, unilateral contract termination is not possible in the following cases:

 

If the service is completed and completion has commenced with the expressed prior consent by the customer,

if the Contract involves a product made by the customer's specification or the product has in any way been conformed or customized for the customer,

if, when determining any product irregularities or flaws, more than half of the product has been consumed.

In order for the customer to exercise the right to unilateral termination of the Contract, they must notify the Company of their decision by sending a written statement by email or post.

 

The Contract can be terminated unilaterally within 14 (fourteen) days from its conclusion.

 

The customer is obliged to return the products to the Company without undue delay, at their own cost, and in any case no later than 14 (fourteen) days after they informed the Company of their decision to unilaterally terminate the contract.  

 

Certain types of items cannot be returned, like perishable goods, custom products (such as special orders or personalized items), gift coupons, and discounted items.

 

Applicable provisions of the Consumer Protection Act shall apply.

We address all customers’ inquiries within 48 hours.

 

Dispute resolution

Any dispute between the seller and the customer will be resolved by mutual agreement and in a peaceful manner. According to the special regulation issued by the European Union on February 15th, 2016, all EU-related internet purchase disputes can be resolved through the ORS platform (ODR). The platform can be used by consumers and merchants, and all complaints can be filed in any of the 25 official languages within the EU. The platform can be accessed through the following link:

Changes to the General Terms of Purchase

The Seller reserves the right to modify the General Terms and Conditions, as well as any changes to the website, its structure, services, or any content, without prior notice to the Customer. The modified terms will take effect at the time of publication on the website.

By using the online store services at www.flyingcatgin.com after the published changes, the Customer is deemed to accept the new General Terms and Conditions.

Svi materijali koji se nalaze na web stranici www.flyingcatgin.com intelektualno su vlasništvo društva te se mogu koristiti isključivo uz izričito odobrenje nositelja autorskih prava, te nositelja prava na žigove i/ili dizajn.

Kupac

Kupac je svaka fizička osoba koja sklapa pravni posao ili djeluje na tržištu izvan svoje trgovačke, poslovne, obrtničke ili profesionalne djelatnosti, te koja prihvaća opće uvjete poslovanja Društva (“Opći uvjeti”).

 

Prihvaćanje Općih uvjeta kupac potvrđuje narudžbom proizvoda putem elektroničke (internet) trgovine. Korištenje usluga i sadržaja internet stranice www.flyingcatgin.com odobrava se isključivo punoljetnim osobama. Društvo ne odgovara za povredu navedene odredbe.

 

Sukladno primjenjivim propisima, osobama mlađim od 18 godina je zabranjena prodaja alkoholnih pića i drugih pića koja sadrže alkohol.

 

Opće odredbe

Ovi Opći uvjeti dostupni su kupcima u svako doba i iste je dozvoljeno spremiti, ponovno koristiti i reproducirati.

 

Općim uvjetima uređuju se odnosi između kupca i prodavatelja vezano uz uvjete i način naručivanja proizvoda, cijene proizvoda, uvjete i načine plaćanja, odgovornost za nedostatke, prava kupca na pisani prigovor na proizvode prodavatelja, pravo na raskid ugovora, uvjete dostave proizvoda, i ostala pitanja važna za sklapanje ugovora o kupoprodaji putem elektroničke trgovine.

 

Opći uvjeti poslovanja čine sastavni dio svakog kupoprodajnog ugovora zaključenog između prodavatelja i kupca ovim putem. Kupci su dužni dati točne, važeće i potpune osobne podatke prilikom ispunjavanja obrasca za registraciju.

 

Prodavatelj je ovlašten, u skladu sa svojom poslovnom politikom, bez potrebe za prethodnom obavijesti, izmijeniti sadržaj Općih uvjeta i druge podatke vezane uz ovu internet stranicu. Izmijenjeni sadržaj Općih uvjeta stupa na snagu odmah nakon objave na ovoj Internet stranici.

 

Cijene

Cijena izražene u našoj online trgovini su maloprodajne, s uključenim PDV-om i naknadom od 0,50 kn (povratna naknada) gdje je ona primjenjiva.

 

Mogućnosti plaćanja

Mogućnosti plaćanja su sljedeće: 

 

• Virmansko plaćanje (općom uplatnicom ili internet bankarstvom) - prije slanja narudžbe.

• Plaćanje pouzećem - po zaprimanju paketa od strane dostavljača.

 

Narudžbe i postupak kupnje

Postupak kupnje započinje narudžbom proizvoda putem elektronskog obrasca narudžbe. Kupnja se obavlja odabiranjem proizvoda u željenoj količini, nakon čega se proizvodi spremaju u košaricu, u kojoj se nalazi pregled odabranih proizvoda s pojedinačnom i ukupnom cijenom. U košarici je moguće povećavati broj proizvoda, brisati ili mijenjati odabrane proizvode. Nakon odabira svih željenih proizvoda i nakon dostavljanja svih traženih podataka nužnih za komunikaciju, prodaju i dostavu, klikom na link NARUČI Kupac potvrđuje narudžbu.

 

Proizvodi se smatraju naručenim i ugovor sklopljen kada kupac obavi plaćanje ili potvrdi prihvat navedene ponude.

 

Pojedini proizvodi mogu biti nedostupni ili rasprodani. O navedenom će kupac biti obaviješten putem e-pošte. Po primitku takve obavijesti kupac je dužan e-poštom obavijestiti prodavatelja prihvaća li novi rok isporuke za neisporučeni proizvod ili želi odustati od kupnje predmetnog proizvoda.

 

Dostava proizvoda

Proizvode iz online trgovine dostavljamo isključivo na području Republike Hrvatske.

Cijene navedene u trgovini ne uključuju trošak dostave. Cijena dostave izračunava se zasebno od strane pružatelja usluge dostave, a ovisi o ukupnoj težini naručenih proizvoda te destinaciji za dostavu proizvoda. Trošak dostave naplaćuje se na jedan od dva načina, ovisno o odabranom načinu plaćanja:

 

• Virmansko plaćanje (općom uplatnicom ili internet bankarstvom) - trošak dostave izračunat će se nakon što Kupac potvrdi narudžbu. Prodavatelj će Kupcu putem emaila dostaviti upute za plaćanje te informaciju o trošku dostave, koji se obračunava zajedno s ukupnom cijenom naručenih proizvoda. Narudžba će biti poslana nakon što Kupac podmiri cjelokupni iznos narudžbe i troška dostave.

• Plaćanje pouzećem - trošak dostave izračunava se i naplaćuje zasebno od strane pružatelja usluge dostave. Kupac je dužan podmiriti iznos dostave u trenutku zaprimanja paketa od strane dostavljača.

 

Materijalni nedostaci i šteta nastala prilikom transporta 

Svi naručeni proizvodi dolaze u prikladnim pakiranjima koja ih štite od oštećenja uzrokovanih uobičajenom manipulacijom u transportu.

 

Kupac je dužan prilikom preuzimanja proizvoda odmah provjeriti eventualna oštećenja te ih reklamirati dostavnom službeniku, odnosno odbiti preuzeti pošiljku na kojoj su vidljiva vanjska oštećenja. U tom slučaju potrebno je obavijestiti prodavatelja kako bi se u što kraćem roku organizirala nova isporuka ili dogovorila alternativna radnja.

 

Jednostrani raskid ugovora

Kupac može jednostrano raskinuti Ugovor u roku od 14 (četrnaest) dana bez navođenja razloga. Kupac nema pravo na jednostrani raskid Ugovora u sljedećim slučajevima:

 

Ako mu je usluga u potpunosti ispunjena, a ispunjenje je započelo uz njegov izričit prethodni pristanak,

ako je predmet ugovora proizvod koja je izrađen po specifikaciji Kupca ili koji je jasno prilagođen Kupcu,

ili ako je prilikom utvrđivanja neispravnosti proizvoda konzumirano više od pola proizvoda.

 

Da bi kupac mogao ostvariti pravo na jednostrani raskid ugovora, mora o svojoj odluci o jednostranom raskidu ugovora prije isteka roka obavijestiti Društvo i to izjavom poslanom poštom ili putem e-pošte te navesti svoje ime i prezime, adresu, broj telefona, telefaksa ili adresu elektroničke pošte.

 

Rok za jednostrani raskid Ugovora iznosi 14 (četrnaest) dana od dana kada je kupcu ili trećoj osobi koju je kupac odredio, a koja nije prijevoznik, roba koja je predmet ugovora predana u posjed.

 

Kupac je dužan o svom trošku robu vratiti Društvu bez odgađanja, a najkasnije u roku od 14 (četrnaest) dana od dana kada je obavijestio Društvo o svojoj odluci da jednostrano raskine ugovor.   

 

U slučaju jednostranog raskida, prodavatelj će izvršiti povrat primljenog novca, uključujući i troškove isporuke, bez odgađanja, a najkasnije u roku od 14 dana od dana primitka odluku o jednostranom raskidu ugovora, s time da povrat novca prodavatelj može izvršiti tek nakon što roba bude vraćena ili nakon što mu se dostavi dokaz da je roba poslana nazad.

 

Povrat novca bit će izvršen na isti način na koji je izvršena uplata. U slučaju da kupac pristane na drugi način povrata plaćenog iznosa, ne snosi nikakve troškove u odnosu na povrat.

 

Upućujemo i na odgovarajuću primjenu važećih odredaba Zakona o zaštiti potrošača. 

 

Prigovori potrošača

Sve eventualne prigovore molimo uputite pisanim putem ili putem elektroničke pošte na adresu brigljevic@gmail.com.

 

Na sve Vaše primjedbe ili upite odgovorit ćemo unutar 48 sati.

Rješavanje sporova

Eventualne sporove prodavatelj i kupac nastojat će riješiti dogovorom i mirnim putem. Posebnom regulativom Europske unije od 15.02.2016., sporove na području EU vezane uz internetsku kupnju moguće je riješiti putem ORS platforme (eng. ODR). Platformu mogu koristiti i potrošači i trgovci, a prigovor je moguće podnijeti na bilo kojem od 25 službenih jezika EU. Platformi možete možete pristupiti putem linka:

Izmjene Općih uvjeta  

Prodavatelj pridržava pravo izmjene Općih uvjeta, kao i bilo koje izmjene internet stranice, njezine strukture, usluge, bilo kojeg sadržaja bez da je o tome prethodno obavijestio kupca. Izmijenjeni uvjeti stupaju na snagu u trenutku objave na stranici.

Korištenjem internet trgovine www.flyingcatgin.com nakon objavljenih izmjena podrazumijeva se da kupac prihvaća sve aktualne Opće uvjete.
